Article 1 – Purpose These terms govern the sales by the company PLONGEZ! of products marketed on its website.
Article 2 – Prices The prices of our products are indicated in euros, inclusive of all taxes (VAT and other applicable taxes on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
In case of an order to a country other than mainland France, you are considered the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be due. These duties and amounts do not fall under the jurisdiction of PLONGEZ!. They will be your responsibility and entirely at your expense, both in terms of declarations and payments to the competent authorities and organizations of your country. We advise you to check these aspects with your local authorities.
All orders, regardless of their origin, are payable in euros.
The company PLONGEZ! reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time of order validation and subject to availability.
Products remain the property of the company PLONGEZ! until full payment of the price.
Attention: as soon as you take physical possession of the ordered products, the risk of loss or damage to the products is transferred to you.
Article 3 – Orders To place an order, you must select each product you wish to purchase and add it to your cart. When you have selected all the products you want to buy, you can confirm the contents of your cart and place the order.
At this stage, you will be redirected to a page summarizing the details of the products you have selected, their price, and delivery options (with the respective delivery costs). You must then choose the delivery options as well as the shipping and payment methods that suit you best.
At the top of this page is the purchase button. You must click on this button to confirm and place your order.
After placing your order, we will send you a confirmation message.
The contractual information is presented in French and will be confirmed at the latest at the time of your order validation.
The company PLONGEZ! reserves the right not to record a payment and not to confirm an order for any reason, and particularly in the case of a supply problem, or in case of difficulty regarding the received order.
Article 4 – Order validation Any order appearing on the website PLONGEZ! implies adherence to these General Conditions. Any order confirmation entails your full and complete adhesion to these general conditions of sale, without exception or reservation.
All the data supplied and the recorded confirmation will be considered as proof of the transaction.
You declare that you have full knowledge of it.
The order confirmation will be considered as a signature and acceptance of the transactions made.
A summary of your order information will be provided to you in PDF formatviathe confirmation email address and attached to your order.
Article 5 – Payment Validating your order implies your obligation to pay the indicated price.
Payment for your purchases is made by credit card through a secure system.
The card is debited at the time of the order. In case of split deliveries, no additional shipping charges will be applied. In case of out-of-stock products, a refund will be made.
Article 6 – Withdrawal In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a 14-day withdrawal period from the receipt of your products to exercise your right of withdrawal without having to justify reasons or pay a penalty.
Returns must be made in their original state and complete (packaging, accessories, notice). Under this condition, your responsibility is engaged. Any damage to the product on this occasion may be such as to defeat the right of withdrawal.
Return costs are your responsibility.
In the event of exercising the right of withdrawal, the company PLONGEZ! will proceed with reimbursement of the sums paid, within 14 days following receipt of the products in their original conditionviausing the same payment method as the one used for the order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:
- The supply of services fully performed before the end of the withdrawal period and whose execution has begun after the consumer’s express prior agreement and express renunciation of their right of withdrawal.
- The supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the professional and likely to occur during the withdrawal period.
- The supply of goods made to the consumer’s specifications or clearly personalized.
- The supply of goods liable to deteriorate or expire rapidly.
- The supply of goods that have been unsealed by the consumer after delivery and cannot be returned for reasons of hygiene or health protection.
- The supply of goods which, after being delivered and by their nature, are inseparably mixed with other items.
- The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.
- The supply of a newspaper, periodical, or magazine, except for subscription contracts to such publications.
- The supply of digital content not provided on a material medium whose execution began after the consumer’s express prior agreement and express renunciation of their right of withdrawal.
Article 7- Availability Our products are offered as long as they are visible on the PLONGEZ! site and within the limits of available stocks. For non-stocked products, our offers are valid subject to availability with our suppliers.
In case of product unavailability after placing your order, we will inform you by email. Your order will automatically be canceled and no bank debit will be made.
Article 8 – Delivery Products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page.
In case of delayed shipment, you will be informed by email about a possible impact on the delivery time initially indicated.
In accordance with legal provisions, in case of delayed delivery, you have the option to cancel the order under the conditions and terms defined in Article L 138-2 of the Consumer Code. If in the meantime, you receive the product, we will proceed with its reimbursement and the forwarding costs according to the conditions of Article L 138-3 of the Consumer Code.
In case of deliveries by a carrier, the company PLONGEZ cannot be held responsible for a delay in delivery due exclusively to a customer’s unavailability after several appointment proposals.
Article 9 – Warranty All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by Articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned, exchanged, or refunded.
All claims, requests for exchange or refund must be made by email within 30 days of delivery.
Products must be returned in the state in which you received them with all elements (accessories, packaging, instructions…). Shipping costs will be refunded based on the invoiced rate, and return costs will be refunded upon presentation of receipts.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.
Article 10 – Liability The products offered comply with current French legislation. The liability of the company PLONGEZ! cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities about the possibilities of importing or using the products or services you plan to order.
Moreover, the company PLONGEZ! cannot be held responsible for damages resulting from misuse of the purchased product.
Finally, the responsibility of the company PLONGEZ! cannot be engaged for all the disadvantages or damages inherent in the use of the Internet, notably a service interruption, an external intrusion, or the presence of computer viruses.
Article 11 – Applicable law in case of disputes The language of this contract is French. These terms of sale are subject to French law. In case of dispute, the Toulon court shall have sole jurisdiction.
Article 12 – Intellectual property All elements of the PLONGEZ! site are and remain the intellectual and exclusive property of the company PLONGEZ!. No one is authorized to reproduce, exploit, redistribute, or use in any way, even partially, elements of the site whether software, visual or audio. Any simple link or hypertext link is strictly prohibited without the express written consent of the company PLONGEZ!
Article 13 – Personal Data The company PLONGEZ! reserves the right to collect personal information and personal data about you. They are necessary for the management of your order, as well as for the improvement of services and the information we send you.
They may also be transmitted to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing, and payment.
These data are also stored for security purposes, to comply with legal and regulatory obligations.
In accordance with the law of January 6, 1978, you have the right to access, rectify and oppose personal information and data concerning you, directly on the website.
Article 14 – Proof archiving The company PLONGEZ! will archive the order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerized records of the company PLONGEZ! will be considered by all parties concerned as proof of communications, orders, payments, and transactions between the parties.
